DMCA & Copyright Policy

Misa respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA) and other applicable laws, we will respond promptly to valid notices of alleged copyright infringement and may remove or disable access to allegedly infringing material.

If you believe content on the Service infringes your copyright, you (or your authorized agent) may submit a written notice containing the following:

• A physical or electronic signature of the copyright owner or authorized agent;
• Identification of the copyrighted work claimed to have been infringed;
• Identification of the allegedly infringing material and enough information to locate it (e.g., the URL);
• Your contact information (address, telephone number, and email address);
• A statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law; and
• A statement, under penalty of perjury, that the information in the notice is accurate and that you are authorized to act on behalf of the owner.

If your content was removed due to a takedown notice and you believe the removal was a mistake or misidentification, you may submit a counter-notification containing:

• Your physical or electronic signature;
• Identification of the removed content and its prior location;
• A statement under penalty of perjury that you have a good-faith belief the material was removed by mistake or misidentification; and
• Your name, address, and telephone number, and consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if you are outside the United States, any judicial district in which Misa may be found).

Counter-notifications may be sent to dmca@misa.app.

In appropriate circumstances, Misa will terminate the accounts of users who are determined to be repeat infringers.

Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing, or that it was removed by mistake, may be liable for damages. Please consider whether fair use, fair dealing, or a similar exception applies before sending a notice.
