Terms of Service

By accessing or using Misa (“the Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to any part of these Terms, you must not use the Service. These Terms are a legal contract between you and Misa, the operator of the Service.

You must be at least 13 years old to use the Service. If you are under the age of majority in your jurisdiction, you confirm that a parent or legal guardian has reviewed and agreed to these Terms on your behalf. By using the Service you represent that you meet these requirements.

You may need an account to access certain features. You are responsible for safeguarding any credentials used to access your account and for all activity that occurs under your account. You agree to notify us promptly of any unauthorized use of your account.

We may suspend or terminate accounts that violate these Terms, applicable law, or that pose a risk to the Service or other users.

You retain all rights to content you submit, post, or display through the Service (“User Content”). By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free license to host, store, display, and reproduce it solely to operate and improve the Service.

You agree not to use the Service to:

• Post content that is illegal, fraudulent, defamatory, harassing, or infringes any third party's rights (including copyrights and trademarks).
• Distribute malware, viruses, or other harmful code.
• Impersonate any person or entity, or misrepresent your affiliation.
• Attempt to gain unauthorized access to the Service, its systems, or other users' accounts.
• Use the Service to violate any applicable law or regulation.

You are solely responsible for your User Content and any consequences of sharing it. We do not pre-screen User Content but may remove or refuse to display it at any time.

The Service may include virtual tokens, collectibles, badges, and other digital items. These items are provided for entertainment purposes, have no monetary value, cannot be exchanged for real-world currency, and are not redeemable for any form of credit or cash.

All purchases are final and non-refundable, except where required by applicable law. Digital items may be modified, removed, or discontinued at any time at our sole discretion, and we are not liable for any loss of perceived value resulting from such changes.

You acknowledge that digital items and tokens do not constitute securities, commodities, or investments, and nothing on the Service should be construed as investment or financial advice.

The Service includes a Discord bot that may offer moderation and utility commands (such as message purging and emoji management) on servers where it is added. You are responsible for ensuring you have the authority to grant the bot the permissions it requires and to use those commands on any server. We are not responsible for actions taken using the bot on servers we do not operate.

The Service, including its software, design, branding, and original content, is owned by Misa and protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works from the Service except as expressly permitted.

You may stop using the Service at any time. We may suspend or terminate your access at any time, with or without notice, if we reasonably believe you have violated these Terms or the law. Provisions that by their nature should survive termination — including Sections 4, 5, 7, 9, 10, and 11 — will survive.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT DIGITAL ITEMS WILL HOLD ANY PARTICULAR VALUE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MISA AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED DOLLARS ($100).

You agree to indemnify and hold harmless Misa, its officers, directors, employees, and agents from and against any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your User Content, your use of the Service, or your violation of these Terms or applicable law.

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above and post the updated Terms. Material changes will be communicated through the Service where reasonably possible. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

These Terms are governed by the laws of the jurisdiction in which Misa operates, without regard to conflict-of-law principles. Any disputes shall be resolved in the competent courts of that jurisdiction, and you consent to the exclusive jurisdiction of those courts.
